Chaparral Insulation Company – Terms of Use

Notice: By accessing Chaparral’s website, online forms, and digital platforms (collectively, the “Site”), users agree to these Terms of Use and the Privacy Policy. Those who do not agree should refrain from using the Site. These Terms apply to public users, employees, contractors, and vendors.
1. Acceptance of Terms
By using the Site, users confirm that:
- They are at least 13 years old, or have parental/guardian consent if under 13.
- They have read and understood these Terms and the Privacy Policy.
- They will comply with all applicable laws.
A notice linking to these Terms appears on the homepage and in the footer of each page.
2. Privacy, Tracking, and Cookies
- The Privacy Policy describes the collection, use, and sharing of personal information and tracking data, including cookies, pixels, and analytics.
- Users are required to provide consent for marketing communications. Consent can be withdrawn at any time.

California Visitors: You have the right to opt out of the sale or sharing of personal information under the CCPA. Essential cookies required for security and functionality always remain active.
3. Use of the Site
Users must:
- Keep account credentials confidential.
- Notify Chaparral immediately of any unauthorized access.
- Use the Site in compliance with the law and without interfering with security or operations.
- Refrain from posting illegal, infringing, harmful, or offensive content.

4. User-Generated Content (UGC)
By posting content such as comments, files, or photos, users represent and warrant that:
- They own the content or have permission to use it.
- The content does not violate laws, privacy rights, or intellectual property rights.
- Employees and contractors comply with internal confidentiality obligations.
Users grant Chaparral a non-exclusive, worldwide, royalty-free license to use UGC for business purposes. Chaparral may remove content that violates these Terms or applicable law.
5. Intellectual Property
All Site content (text, graphics, images, videos, logos, software) is owned by Chaparral or its licensors.
- Copying, modifying, distributing, or creating derivative works requires prior written permission.
- Use of trademarks or logos requires prior written consent.
6. Communications (SMS, Email)
- Chaparral may send transactional, informational, or marketing communications by SMS, email, or similar technologies, subject to applicable law and user consent requirements.
Employment-Related Communications.
By providing a mobile phone number in connection with a job application, employment, or payroll records, individuals provide consent to receive text messages from Chaparral that are reasonably related to recruiting, hiring, onboarding, scheduling, payroll, benefits, compliance, safety, or other required employment or business communications. These messages are informational and not marketing. Message frequency may vary. Consent is not required to access or use the informational Site.
Marketing Communications.
Marketing or promotional messages will be sent only where express consent is required and obtained under applicable law.
- Users may opt out of SMS communications at any time by replying STOP or request assistance by replying HELP. Message and data rates may apply.
- Users represent that they are authorized to use the wireless device associated with the provided phone number.
- Delivery of messages is subject to carrier and device limitations.
- Messaging services are provided on an “AS-IS” basis and are available only within the United States.
- Chaparral does not share SMS opt-in data with third parties for their independent marketing purposes.
- Chaparral may use third-party service providers, including messaging vendors, to deliver communications, but Chaparral remains responsible for compliance with applicable laws.
- Internal messaging by employees, contractors, or vendors must comply with Chaparral’s internal policies.
- Chaparral may modify, suspend, or terminate messaging services at any time.
7. Third-Party Links
The Site may link to third-party websites. Chaparral is not responsible for their content, products, services, or policies. Users must review third-party terms and privacy policies.
8. Security & Account Obligations
Users may not:
- Bypass security measures or access unauthorized data.
- Introduce malware or viruses.
- Share account credentials with others.
Users are responsible for all activity conducted through their accounts.
9. Disclaimers & Limitation of Liability
- THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
- CHAPARRAL DOES NOT GUARANTEE ACCURACY, COMPLETENESS, OR UNINTERRUPTED ACCESS.
- USE OF THE SITE IS AT THE USER’S OWN RISK.
- CHAPARRAL IS NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES TO THE EXTENT PERMITTED BY LAW.
- DIRECT DAMAGES ARE LIMITED TO THE AMOUNT PAID FOR PRODUCTS OR SERVICES, IF ANY.
- USERS ARE RESPONSIBLE FOR THEIR OWN BACKUP AND VIRUS PROTECTION PROCEDURES.
- AGGREGATE CAP: IF ANY PART OF THIS LIMITATION IS UNENFORCEABLE, CHAPARRAL’S TOTAL LIABILITY WILL NOT EXCEED $10.
10. Dispute Resolution & Governing Law
- CLASS-ACTION WAIVER: USERS WAIVE THE RIGHT TO PARTICIPATE IN ANY CLASS-ACTION LAWSUIT OR CLASS ARBITRATION AGAINST CHAPARRAL.
- PUBLIC USERS AGREE TEXAS LAW GOVERNS. DISPUTES WILL BE RESOLVED EXCLUSIVELY IN STATE OR FEDERAL COURT IN WACO, MCLENNAN COUNTY, TEXAS, EXCEPT AS OTHERWISE REQUIRED BY LAW. USERS CONSENT TO THE PERSONAL JURISDICTION OF THESE COURTS.
- CHAPARRAL MAY PURSUE CLAIMS IN OTHER JURISDICTIONS AS NEEDED.
- INTERNAL USERS (EMPLOYEES, CONTRACTORS, VENDORS) AGREE TO ARBITRATION OR OTHER INTERNAL DISPUTE RESOLUTION PROCEDURES BY USING INTERNAL ACCOUNTS.
11. Indemnity
- USERS AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS CHAPARRAL, ITS AFFILIATES, OFFICERS, AND EMPLOYEES FROM CLAIMS, DAMAGES, OR EXPENSES ARISING FROM VIOLATIONS OF THESE TERMS OR APPLICABLE LAW.
12. Modifications
Chaparral may update these Terms at any time. Changes become effective upon posting. Continued use of the Site constitutes acceptance of the revised Terms.
13. Severability & Waiver
If any provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision does not waive future rights. All waivers must be in writing and specify the provision being waived.
14. Employees/Contractors
Employees, contractors, and vendors using Field Materials, Bluebeam, or other internal platforms must:
- Follow internal security, privacy, and operational policies.
- Not share login credentials or sensitive data.
- Use systems only for authorized business purposes.
- Logging in constitutes agreement to internal Terms of Use.
